Court Rejects Appeal of Sullivan Man in Fatal Overdose Case

The state supreme court has upheld the conviction of a man from Sullivan for giving prescription drugs to another man who died the next day.

47-year-old Bruce Merchant appealed his case, saying police didn’t support his Miranda rights when when he was being interviewed.

The court disagreed.

Merchant was found guilty of unlawful furnishing of drugs in August of last year.

Prosecutors say in September of 2010, Merchant gave oxycodone to Charles Robinson.

Robinson overdosed and his wife found him dead the next morning.
