Lawyers for a Scarborough man charged with kicking and stomping a woman on a Portland street with such severity that she was left with permanent brain damage have asked a judge to throw out some evidence in the case. Attorneys for 28-year-old Eric Gwaro asked a judge Wednesday to dismiss eyewitness accounts of the August attack because the witnesses were only able to identify Gwaro after seeing his photo in media reports. They also argued that Gwaro was “heavily intoxicated and physically exhausted” at the time of his arrest and any statements he made after his arrest also should be thrown out. The Portland Press Herald, reports that the judge did not immediately rule. Gwaro has denied assaulting the 25-year-old woman, saying he was chasing the attacker.
