Judge Rejects Lawsuit Filed on Behalf of Creator of Website That Targeted Eliot Cutler 

A federal judge says a fine imposed by the state doesn’t violate the free speech rights of one of the creators of a political website that targeted independent Eliot Cutler in the 2010 gubernatorial race. District Judge Judge Nancy Torresen on Monday rejected the lawsuit filed on behalf of Dennis Bailey, who said his website should get the same protections as traditional news media. Torresen said Bailey’s claim to be a “citizen journalist” didn’t fly since he worked for two candidates, first Democratic candidate Rosa Scarcelli and then independent Shawn Moody. Zachary Heiden of the Maine Civil Liberties Union says state law hasn’t kept pace with changing technology and that the anonymous speech should be protected. He says no decision has been made on an appeal.
