Jury Finds Man Accused of Raping Girl Guilty of a Lesser Crime 

A man from Aroostook County who allegedly raped his ex-girlfriend’s 13-year-old daughter was found guilty of a lesser crime. Late Wednesday afternoon, a jury in Bangor cleared 26-year-old David Churchill of Fort Fairfield of the most serious charge of gross sexual assault. He was convicted of unlawful sexual contact.Churchill was accused of sexually assaulting the teenager, who was twelve years old at the time, in the summer of 2009.Defense Attorney Hunter Tzovarras says they will consider an appeal.”There will be a sentence hearing on the class C charge that he was convicted of and we anticipate that we may file an appeal as well,” Tzovarras told a Channel 5 reporter shortly after the verdict was read.A sentencing date has not been set yet, Churchill faces a five year maximum but Deputy District Attorney Michael Roberts hopes the young girl’s age plays a part in determining the sentence.”Given his lack of prior history, I’m certain the judge will suspend part of that, I would like to ask a sentence with the Department of Corrections, this type of offense warrants more than a county jail sentence,” Roberts said.Churchill remains free and was ordered not to have contact with the victim or her family and he cannot travel to Bangor, unless for legal or medical reasons.
