Woman Strip-Searched at Penobcot Co. Jail Can Take Case to Trial

The case of a woman who says she was illegally strip-searched at the Penobscot County Jail will go to trial. A federal judge ruled Tuesday that Tina Oxley can go ahead with a lawsuit against Penobscot County. U.S. District Judge John Woodcock backed another judge’s recommendation to allow the 36-year-old woman to sue for violation of her constitutional rights. Oxley says three years ago she was needlessly strip-searched when she was arrested for driving with a suspended license. Her lawyer argues there was no reason to suspect she had a weapon or drugs hidden on her body.A lawyer for the county, though, contends the strip search was necessary because another woman in Oxley’s car was found with drugs. The case is currently scheduled for a federal jury trial August 3rd.
