IT WAS TIME FOR QUESTIONS…ON AN ISSUE THAT’S BEEN BACK-AND-FORTH BETWEEN CITIZENS, LAWYERS AND THE TOWN OF HERMON…AT TIMES, IT WAS HEATED.

&quot:you have cost us thousand of dollars.&quot:

THE QUESTION AT HAND…SHOULD RESIDENTS BE ALLOWED TO VOTE THEIR TOWN MANAGER OUT OF HIS POSITION

&quot:i don’t know why you can’t have a contract with your town manager that says he’s subject to this new provision in your town charter.&quot:

SOME SAY HISTORY BETWEEN CURRENT AND FORMER MEMBERS OF TOWN COUNCIL HAS CLOUDED THE ISSUE…

THE TOWN BROUGHT IN TOM RUSSELL, A BANGOR LAWYER, AS AN IMPARTIAL THIRD PARTY TO REVIEW THE AMENDMENT. HE SAYS THE PROPOSAL ISN’T LEGALLY SOUND.

&quot:in my opinion the amendment fails to comply with the requirements of due process&quot:

SHOULD THE MEASURE PASS AND VOTERS EVER DECIDE TO FIRE THE TOWN MANAGER, RUSSELL SAYS IT WOULD BE UNCONSITUTIONAL.

&quot:the manager has a right to a fair and impartial hearing, to examine and to cross examine witnesses, and to present the managers own case and be represented by counsel.&quot:

SOME RESIDENTS AGREE.

&quot:you can’t supercede, at a municipal level, state and federal law, that’s the bottom line. If it’s an issue of a personality conflict, that doesn’t pass the test.&quot:

THE PROPOSED AMENDMENT WILL BE ON THE NOVEMBER BALLOT.
