But this is no dispute between neighbors, this battle is with the Department of Transportation.
At the center of the dispute is a seven foot tall fence.
According to the D.O.T. the fence, which runs near the railroad track, was put up to ensure safety, and for liability reasons.
The landowners say the fence was put up out of spite.
Andrea Lapointe and her husband say their deed says the land next to the train tracks belongs to them and since a court ruling in D.O.T.’s favor have had to remove personal property 19 feet away from the rail line.
The rail line has not been in use for several years.
Lapointe has filed an appeal and a supreme court judge is expected to hear the case sometime this month.
