The Maine Center for Disease Control says randy beal scraped mussels off a barrel found floating in the ocean around Jonesport, and served them to his family Tuesday night.
Beal is in critical condition at Eastern Maine Medical Center.
His wife, Brenda, has been upgraded from critical to serious condition.
Their son, Jonathan, is in fair condition and daughter, Tina, has been released.
The Commissioner of Marine Resources says crews have wrapped up their testing for more toxic algae and determined the Jonesport area is clean.
He says this was an isolated and usual case.
